Evidence inpatient treatment
For inpatient treatment, hospital confirmation, expected duration, transport fitness and treating unit matter. The application should show why transfer is currently impossible or dangerous to life.

Serious illness shortly before sentence start is not a side issue. Section 5 StVG covers cases where enforcement of a prison sentence is not feasible because of illness, injury, invalidity or physical or mental weakness, or where transfer would endanger life.
This article separates Section 5 StVG from postponement under Section 6 StVG and from general sentence-start preparation. The focus is on current medical evidence, transport fitness, hospital situation, medication plan and the correct procedural track before escalation.
The assessment depends on whether there is current evidence, inpatient treatment or only a general complaint.

A generic certificate is rarely enough. Current reports, diagnosis, functional limitations, medication plan and a specific statement on fitness for enforcement or transport are helpful.
Section 5 StVG contains specific rules for pregnancy and the period after birth. Medical confirmation, expected or actual birth date and care situation should be set out separately.
Without current medical records, Section 5 StVG is difficult to argue. First obtain reports, discharge letter, medication plan and reliable contact details for the treating provider.
Section 5 StVG concerns unfitness for enforcement. The question is not whether personal or economic reasons make reporting difficult, but whether enforcement corresponding to the nature of imprisonment is feasible with available prison facilities.
This differs from postponement under Section 6 StVG. If illness is presented only as hardship, the medical core is lost. If the request merely asks for time although transport fitness or danger to life is central, the focus is wrong.
Current, verifiable records matter: medical report, hospital confirmation, medication plan, surgery report, discharge letter and a statement on transport or admission into the relevant institution.
Generic statements such as unfit for prison are weaker than a clear medical explanation. The file should show which authority or provider checked what and which documents are available.
Fitness for custody in pre-trial detention is a different procedural situation. Section 5 StVG concerns the start of enforcement after conviction. Postponement under Section 6 StVG remains a separate route for personal, family or economic reasons.
The application should therefore identify the track precisely. Medical unfitness, ordinary postponement and general preparation for sentence start must not be mixed.
The overview helps separate this specialist topic from existing core content.
| Situation | Evidence | Why it matters |
|---|---|---|
| Hospital Hospital | admission confirmation, duration | shows current unavailability |
| Transport Transport | medical statement on transport fitness | assesses transfer risk |
| Treatment Treatment | medication plan, appointments | shows ongoing need |
| Prison Prison | specific care requirement | checks whether enforcement is feasible |
Section 5 StVG requires a specific enforcement assessment. Each case needs current medical records.
Important: Section 5 StVG should be prepared before a missed sentence-start date. Later explanations without records are much weaker.
