Under section 54a(1) of the Austrian Prison Act, a person in prison may use house money and, under the condition stated there, half of the reserve for payments to maintenance-entitled relatives. A clear instruction to the prison authority and a traceable payment record help assign the correct amount to the correct purpose.

Prison work pay is divided into different funds during imprisonment. A general reference to prison funds therefore does not answer the maintenance question. This article explains which funds section 54a names, how to prepare an instruction and which documents matter when an account entry is unclear.

01 Question 1

Which step is in the foreground for the maintenance payment?

Section 54a(1) of the Austrian Prison Act refers to house money and, under a statutory condition, half of the reserve. Start by identifying the concrete question.

Which money question is in the foreground?

The instruction should clearly identify the maintenance beneficiary, purpose and requested payment amount.

Section 54a(1) of the Austrian Prison Act permits the listed funds to be used for payments to maintenance-entitled relatives. The instruction should therefore identify the recipient, purpose, period and requested amount. Add bank details only from a reliable source.

The prison authority must be able to assign the instruction to the correct fund. Attach the maintenance title or agreement and a current account statement. For recurring payments, clarify how further instructions will be recorded.

Section 54a(1) refers to house money and, subject to the statutory condition, half of the reserve.

The provision refers to house money and half of the reserve if the statutory condition is met. A general reference to prison funds therefore does not resolve the issue. The relevant question is how the prison authority records the balance and which fund it belongs to.

Section 54a(3) addresses a different purpose: purchases that promote progress after release. The prison governor decides on that use. It does not replace the review of a maintenance instruction under section 54a(1).

A traceable record connects the instruction with the account booking and receipt by the beneficiary.

Keep the instruction to the prison authority, its response, the account statement and every transfer record. The maintenance beneficiary should be able to identify the period and purpose for which the payment was made.

A general note such as maintenance may be insufficient where arrears exist. Assign each payment to a specific period or agreed instalment and compare it with the maintenance title. This makes open amounts and incorrect bookings easier to identify.

An unclear refusal or booking requires the account balance, reasons and legal basis to be secured.

Request a clear breakdown of the affected funds and a written explanation of the disputed step. Record when the instruction was submitted, which amount was available and how the prison authority responded.

The available legal remedy depends on the specific measure and its legal basis. The complete correspondence, account statement and maintenance title are therefore needed. A general statement about a deduction cannot replace these documents.

Section 54a creates a specific route for support payments

Section 54a(1) of the Austrian Prison Act provides that house money and, subject to a statutory condition, half of the reserve are also available for payments to maintenance-entitled relatives. The provision also refers to payments to people whose rights were injured by the criminal act and to debt repayment. This article focuses on maintenance payments.

The provision governs the use of funds administered during imprisonment. It therefore addresses which funds can be used for the stated purpose. Whether a maintenance obligation exists and in what amount is a separate question. The maintenance title, agreement, arrears and current ability to pay must be reviewed for that purpose.

Where a prison sentence exceeds one year, section 54a(2) requires information at the start of the sentence and when the reserve exceeds EUR 1,000 about the possible uses of house money and the reserve. The prison authority should also provide guidance and support for a meaningful use of the funds within the available facilities.

Classify house money, reserve and private funds correctly

Everyday language often refers to prison funds or private funds. Section 54a(1), however, uses the terms house money and reserve for this payment route. Half of the reserve is available only if the condition stated in the provision is met. The instruction should therefore refer to the current account breakdown.

The fund designation affects the next step. House money and the reserve are treated differently during imprisonment. A total balance leaves open which amount is to be used and whether the statutory condition for the reserve is met.

Section 54a(3) addresses a different purpose. House money and the reserve may be used for purchases that promote progress after release. The prison governor decides on that use. Such a purchase must be kept separate from a payment to maintenance-entitled relatives under subsection 1.

Funds during imprisonment

How to classify house money and reserve for maintenance

The fund type and payment purpose determine the first review step.

Uses under section 54a of the Austrian Prison Act
Fund or purpose Legal question Review for the instruction
House money House money Section 54a(1) names it for payments to maintenance-entitled relatives. State the balance, purpose and recipient clearly.
Half of the reserve Half of the reserve Use depends on the statutory condition in section 54a(1). Review the reserve balance and relevant protection limit.
Total balance Total prison funds The total balance alone does not show the fund type or available half of the reserve. Request a breakdown of the individual funds.
Progress after release Purchase under section 54a(3) This purpose concerns a purchase and a decision by the prison governor. Keep it separate from the maintenance instruction.

The table summarises the purposes in section 54a. The specific booking and maintenance documents remain decisive.

Prepare an instruction to the prison authority

Address the instruction to the prison authority holding the funds and identify the person in prison clearly. Name the maintenance beneficiary, purpose, period and amount. For a bank transfer, include the beneficiary details in the documents. Use a reliable source for every account number and check each figure before submission.

Attach the maintenance title, court decision or relevant agreement. The documents should show who is to receive the payment and which period or instalment is concerned. Where arrears exist, the instruction should state the allocation clearly so that the payment can be booked correctly.

For recurring maintenance, ask the prison authority how follow-up instructions and their execution are documented. A single payment does not automatically prove that all arrears have been settled. Keep the instruction, response and every account booking together.

Process

How to prepare a maintenance payment from prison funds

The steps connect the account breakdown, maintenance documents and payment record.

  1. 01
    Clarify funds
    Before the instruction

    Obtain a current breakdown

Have house money and reserve shown separately before directing an amount.

Request the current balance and the name of each relevant fund. The condition for using the reserve under section 54a(1) requires a separate review.

Legal basis: Section 54a(1) Austrian Prison Act

  2. 02
    Document support
    With the instruction

    Record recipient and period

Assign the payment to the maintenance title, agreement and specific period.

Attach the maintenance documents and the beneficiary bank details. If arrears exist, the instruction should show which amount is intended for which period.

Legal basis: Section 54a(1) Austrian Prison Act

  3. 03
    Direct payment
    After submission

    Request written execution

Ask for a traceable allocation of the instruction to the correct fund and recipient.

Keep a copy of the instruction and the prison authority response. For recurring payments, clarify how follow-up instructions are recorded.

Legal basis: Section 54a(1) Austrian Prison Act

  4. 04
    Secure proof
    After execution

    Compare booking and receipt

Compare the account entry, payment record and allocation to the maintenance period.

If the booking differs from the instruction, request a written explanation and preserve the complete correspondence.

Legal basis: Section 54a Austrian Prison Act

    Preserve documents in prison proceedings

Bring payment, arrears and account records together

For a later review, keep four connected documents together: the maintenance title or agreement, the instruction to the prison authority, the account breakdown and the payment record from the beneficiary. They show the intended amount, the fund from which it was to be taken and whether the payment was executed.

Where arrears exist, assign every payment to a period or instalment. This matters when several claims or ongoing payments exist at the same time. A payment from prison funds also does not automatically answer whether the maintenance obligation needs to be recalculated for the future.

If a booking is missing or a different amount was deducted, request a clear explanation. For a measure taken by the prison authority, the exact content, date and stated legal basis determine the next review. Keep those details with the maintenance documents.

Keep maintenance payment and garnishment separate

Section 54a(1) describes a way to use listed funds for payments to maintenance-entitled relatives. A payment arranged for that purpose is conceptually different from an enforcement garnishment. The same account documents may be relevant to both, but the legal questions are different.

A garnishment or other deduction requires review of the specific measure and its legal basis. A maintenance instruction first requires a clear allocation of recipient, purpose and amount. Mixing both processes can lead to the cause of an account entry being assessed incorrectly.

A separate article provides an initial overview of garnishment, maintenance and debt questions in prison. It helps distinguish the prison account, external claim and maintenance issue, while the specific payment route remains governed by section 54a.

Frequently asked questions

Questions about maintenance payments from prison funds

Can all prison funds be used for maintenance? +

Section 54a(1) names house money and, subject to the condition stated there, half of the reserve. The total prison balance therefore does not by itself show which amount can be used for a maintenance payment. The fund types and current account breakdown must be reviewed.

Must the prison authority explain how house money and reserve may be used? +

For a prison sentence exceeding one year, section 54a(2) provides for information at the start of the sentence and when the reserve exceeds EUR 1,000. The prison authority should also provide guidance and support for a meaningful use of the funds within the available facilities.

What should I do if a maintenance booking is unclear? +

Secure the complete maintenance title, instruction, account breakdown and payment record. Ask the prison authority for a clear explanation of the booking. The specific measure and its stated reasons determine the further legal review.
