Immigration detention involving minors or families is not an ordinary detention issue. § 76 FPG contains special rules for minors. Very young minors must not be held in immigration detention. For older minors, alternatives are prioritised where they can achieve the purpose.

For families, documentation matters: age, custody, care, school, health, accommodation, travel documents, flight risk and possible alternatives. A complaint to the Federal Administrative Court under § 22a BFA-VG is assessed by reference to the concrete detention.

§ 76 FPG and minors

§ 76 FPG sets a special threshold for minors. Very young minors must not be held in immigration detention. For older minors, the authority must use alternatives unless specific facts justify otherwise and statutory conditions are met.

The best interests of the child are therefore not a slogan. They must appear in the file: age, care, family, school, health, accommodation and a concrete alternative to detention.

Preparing alternatives under § 77 FPG

§ 77 FPG lists alternatives, including accommodation in specified premises, and family and child-appropriate premises where minor children or families are involved. Reporting duties or security may also be relevant.

In practice, anyone arguing for an alternative should offer a concrete address, care arrangement, availability and cooperation. General references to family are too weak.

BVwG review and documentation

§ 22a BFA-VG provides review against immigration detention, arrest or detention. The Federal Administrative Court examines the concrete situation and, if detention continues, whether it remains lawful.

For families, the court needs a verifiable alternative and the child welfare arguments quickly.
